1. Acceptance of Terms

By accessing our website or subscribing to our monthly web design services ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

2. The Service & Subscription

PAYGwebsites provides managed web design and hosting services on a subscription basis.

  • Minimum Term: All plans are subject to a minimum 12-month contract term ("Initial Term").
  • Rolling Contract: After the Initial Term, your subscription will automatically renew on a rolling monthly basis unless cancelled.
  • Inclusions: Your monthly fee covers hosting, SSL certificates, technical maintenance, and the allocated hours of design changes as specified in your chosen plan.

3. Payments & Billing

Subscription fees are billed automatically every month via our payment processor (Stripe). You authorize us to charge your payment method on file for these fees.

Late Payments: If a payment fails, we will attempt to retry the charge. If payment is not received within 7 days, your website may be temporarily suspended until the balance is cleared.

4. Cancellation & Early Termination

After Initial Term: You may cancel your service at any time after the first 12 months by providing 30 days' written notice. There are no cancellation fees after the Initial Term.

During Initial Term: If you wish to cancel before the 12-month minimum term is complete, you are required to pay an "Early Termination Fee" equal to 50% of the remaining balance of your contract, or a "Buyout Fee" (see Section 5) if you wish to keep the website files.

5. Intellectual Property & Ownership

During Subscription: PAYGwebsites retains all ownership rights to the website code, design assets, and server configuration. You retain ownership of your specific domain name and your provided text/images.

Transfer of Ownership (Buyout): If you wish to transfer the website to another host or take full ownership of the code, a buyout fee applies. This fee is calculated based on the complexity of the site and the time remaining on your contract. Upon payment of the buyout fee, we will provide a full backup of your site files.

6. Limitation of Liability

We strive for 99.9% uptime, but we cannot guarantee that our service will be uninterrupted or error-free. To the fullest extent permitted by law, PAYGwebsites shall not be liable for any indirect, incidental, or consequential damages (including loss of data or business interruption) arising out of the use of our service.
